1. Introduction

UAE.Ctbabe.com ("the Platform") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and UAE Federal Law No. 38 of 2021 on Copyrights and Neighbouring Rights, we will respond promptly to claims of copyright infringement committed using our Platform.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Platform, please notify our designated DMCA Agent as described below.

3. Filing a DMCA Complaint (Takedown Notice)

To file a valid DMCA takedown notice, you must provide the following information in writing:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work(s) you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
  • Identification of the material you claim is infringing and that you request to be removed, including the specific URL(s) or sufficient information to locate the material on our Platform.
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Important: Incomplete notices may not be processed. Please ensure your notice contains all the required elements listed above.

4. Counter-Notification Process

If you believe your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent containing the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (URL).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your district and that you will accept service of process from the person who provided the original takedown notification (or their agent).

Upon receiving a valid counter-notification, we may restore the removed material within 10-14 business days, unless the original complainant files a court action seeking a restraining order against the user.

5. Repeat Infringer Policy

Ctbabe maintains a strict policy regarding repeat infringers. In accordance with applicable law, we will:

  • Terminate the accounts of users who are determined to be repeat infringers.
  • Remove all content associated with repeat infringer accounts.
  • At our sole discretion, limit access or terminate the account of any user who has been the subject of multiple valid DMCA complaints, regardless of whether a formal legal action has been taken.

6. User Responsibility

By uploading content to the Platform, you represent and warrant that:

  • You are the original creator of the content, or you have obtained all necessary rights and permissions from the original creator to upload and display the content.
  • Your content does not infringe upon the copyright, trademark, privacy, publicity, or other intellectual property or personal rights of any third party.
  • You understand that any content found to be infringing will be promptly removed and your account may be subject to termination.

7. Good Faith Statement & Misrepresentation Warning

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
